Trademark Registration for Everyone, Fear of Lawsuits for None!

The US Patent and Trademark Office hosts an online system for registering trademarks with which every online merchant should be familiar. Registering a US trademark is central to every well-planned branding strategy.

Trademark registration isn’t simply for the megacorporations whose products are household names. Growing companies are wise to harness the power of brands and trademarks by registering the words, phrases, and images they use in commerce, and have become associated with their goods and services.

Trademarks are one of the most powerful weapons in the corporate lawyer’s arsenal, and the US trademark law, called the Lanham Act, provides for powerful court remedies that terrify many lawyers unfamiliar with the law. In truth, if you properly understand what Congress meant to do when it enacted the Lanham Act, and if you know how the Federal Courts have interpreted it sensibly over the many years it has been law, there’s no reason to fear trademark lawsuits any more than any other type. Particularly if you’ve been well advised in advance, and have used the trademark laws to your advantage, rather than straying into harm’s way, there’s nothing to fear.

Charles Carreon is experienced in performing trademark registrations, and has successfully registered his clients’ trademarks in a wide range of Internet and media-related fields, including software and cinema. As counsel to the world-famous trademark-wielder, Louis Vuitton, he got counterfeit luggage off the streets of LA by the truckload, making the world safe for the inflated egos of those who can’t stand seeing a knockoff of what they’ve paid for dearly in the hand of elderly cleaning lady waiting for a bus. After leaving Vuitton’s employ, he turned what he’d learned in its service defending small businesses against bogus trademark lawsuits in several jurisdictions. Based on his experience, Charles advises: “Never rely on an amateur’s opinion regarding something that could result in treble damages.”
